These Terms govern your access to and use of GundogsMarket ("we", "us", "our"), including all listings, communications, and services provided through the platform ("Platform").

By accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, you must stop using the Platform immediately.

1. Acceptance of Terms

By using GundogsMarket, you confirm that you have read, understood, and agree to be legally bound by:

• Our Animal Welfare & Advertising Standards Policy
• Our Seller Requirements Policy

If you do not agree, discontinue use immediately.

2. Eligibility & Accounts

a. You must be at least 18 years old and able to enter a binding contract.

b. You are responsible for keeping your login credentials secure.

c. You must notify us immediately of any unauthorised account access.

d. We may refuse, suspend, or terminate accounts at our discretion.

e. Closing your account removes access to all account-restricted features.

f. Deleted accounts cannot be restored, and listings will be permanently removed.

3. User Responsibilities

By using the Platform, you agree to:

Provide accurate, complete, and lawful information.

Comply with all UK laws, including:

• Animal Welfare Act 2006
• Animal Welfare (Licensing of Activities Involving Animals) Regulations 2018
• Microchipping of Dogs Regulations
• Consumer Protection and Advertising laws (ASA/CAP Code)

Treat animals legally and humanely at all times.

Not misrepresent any animal's age, breed, health, or pedigree.

Hold all required breeder licences and provide them when necessary.

Not harass, deceive, defraud, or abuse users.

Act responsibly when arranging viewings, transport, or transactions.

4. Listings & Animal Welfare Requirements

a. All listings must be truthful, accurate, and not misleading.

b. Required information (when applicable):

• Age, breed, sex, temperament
• Microchip details
• Health tests and certifications
• Breeder licence number & issuing authority

c. You must not list animals prohibited under UK law (including restricted breeds).

d. Animals must not be advertised before 8 weeks of age.

e. We may remove, edit, or suspend listings that appear unlawful or unsafe.

f. We may request verification documents at any time.

g. Multiple-dog listings are prohibited unless the category allows it.

h. All listings (including stud listings) last 6 months unless renewed.

5. Transactions, Fees & Payments

a. GundogsMarket is not a party to any transaction between buyers and sellers.

b. We do not guarantee the identity, licensing status, or legitimacy of users.

c. Paid features (boosts, promotional upgrades, premium services) are billed in advance.

d. Payments are processed by third-party providers; their terms apply.

e. We are not liable for disputes, fraud, or losses arising from transactions.

6. Prohibited Uses

You must NOT:

• Post unlawful, harmful, or infringing content
• Conduct illegal or unlicensed animal sales
• Impersonate others or misrepresent licensing
• Scrape data or misuse the Platform
• Attempt to hack, disrupt, or bypass security
• Post animals intended for fighting or unlawful purposes
• Engage in deceptive, abusive, or fraudulent activity

7. Anti-Solicitation / Prohibited Commercial Contact (NEW)

a. You may not use the Platform to promote unrelated services, websites, social media channels, or commercial offerings.

b. Unsolicited contact made for marketing, advertising, recruitment, or business promotion is strictly prohibited.

c. Such behaviour may violate UK law, including PECR (Privacy and Electronic Communications Regulations 2003).

Violations will result in:

• Account suspension or termination
• IP blocking
• Removal of all associated content
• Possible legal action
• Reporting to authorities where relevant

We reserve the right to monitor communications where misuse is suspected.

8. Content Ownership & Licence

a. You retain ownership of your content.

b. By posting, you grant us a worldwide, royalty-free licence to host, display, and distribute your content to operate and promote the Platform.

c. You may only upload content you have legal rights to use.

d. We may remove content that violates these Terms or law.

9. Reporting Abuse (NEW)

To protect the integrity of the Platform:

a. You must report misuse, fraud, suspicious activity, or welfare concerns.

c. All reports are confidential.

d. We investigate every complaint and take appropriate action.

10. Third-Party Links & Integrations

The Platform may link to or integrate with third-party websites or services.

We do not control or endorse third-party content and are not responsible for their practices.

11. Disclaimers

a. The Platform is provided "as is" and "as available."

b. We do not guarantee:

• Accuracy of listings
• Success of transactions
• Identity or legitimacy of users
• Uninterrupted availability

c. We do not verify breeder licensing unless explicitly stated.

d. We are not responsible for any outcome of buyer-seller interactions.

12. Limitation of Liability

To the fullest extent permitted by law, GundogsMarket is not liable for:

• Indirect, consequential, or incidental loss
• Fraud or misconduct by users
• Loss of profit, data, goodwill, or reputation
• Issues arising from animal sales, health, transport, or welfare

If liability cannot be excluded, it is limited to the amount paid for Platform services in the past 12 months.

13. Indemnity

You agree to indemnify and hold GundogsMarket harmless from all claims, losses, and expenses arising from:

• Your listings or content
• Your breach of these Terms
• Your violation of law or licensing requirements
• Your transactions with users

14. Suspension & Termination

We may suspend, restrict, or terminate your account without notice if:

• You breach these Terms
• You violate UK law
• We suspect fraud or harmful activity
• Your behaviour risks harm to users, animals, or the Platform

15. Changes to Terms

We may update these Terms at any time.

Continued use after changes indicates acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales.

Users agree to submit to the exclusive jurisdiction of the courts of England and Wales.
